General Terms and Conditions of Participation in Events organised by Grupa Start Sp. z o.o.

- GENERAL PRINCIPLES
- The objective of GRUPA START Sp. z o.o. Incoming Tourism Agency, hereinafter referred to as VISIT.PL, is to provide all its Clients with the best possible conditions of participation in the events it organises, in accordance with the principles set down in these General Terms and Conditions of Participation and in contracts, and taking into consideration of the wishes of individual Clients.
- The detailed conditions applicable to the events organised by VISIT.PL, such as site locations, standards and programmes, are defined in VISIT.PL's current Catalogue, which is accessible on the Internet at www.visit.pl. If an event is not published in the Catalogue, VISIT.PL shall inform the Client of the conditions applicable to this event.
- CONCLUDING A CONTRACT
- These General Terms and Conditions of Participation, together with the Catalogue, constitute an integral part of any contract for participation in an event.
- A contract is concluded when the following conditions are met:
- The Client submits a correctly completed order form. Order forms may be submitted on line by filling out and sending the Order Form included on the site www.visit.pl; by faxing or e-mailing a filled-out Order Form to VISIT.PL; or by telephone. Where order forms are submitted on line, the Client gains access to a page detailing the status of his/her order.
- VISIT.PL confirms receipt of the order form and undertakes the organisation of the events ordered by the Client,
- The Client makes payment of all or part of the sum due in accordance with the provisions in par. III.
- On receipt of payment equal to 100% of the value of the order, VISIT.PL shall issue and send to the Client a voucher entitling him/her to take advantage of the events ordered.
- If the Client provides incorrect contact details (e-mail address) and as a consequence VISIT.PL is unable to contact the Client, the confirmation referred to in point 2b is considered delivered as long as it has been sent by VISIT.PL to the address given by the Client.
- TERMS OF PAYMENT
- The Client chooses whichever of the following forms of payment s/he prefers, as long as the given form of payment is available for the event ordered by the Client:
- Credit card. Credit card details may be provided on line, in an encoded e-mail message, by fax or by telephone.
- Bank draft into VISIT.PL's account in US dollars or in euro.
- The following provisions are applicable to credit card payments:
- VISIT.PL shall quote the Client the sum payable in Polish zloty. The figure given in Polish zloty shall be converted into the currency in which the Client's bank account is held by the competent organisations and banks servicing the card in accordance with the tables of exchange rates, fees and commission they use. VISIT.PL does not bear any liability for differences in exchange rates or for any possible losses or damages incurred in connection with the use of credit cards.
- The authorisation of the credit card whose details are given by the Client shall take place immediately VISIT.PL receives the order, or, in the case of payment on line, during the order submission process.
- The Client's credit card shall be charged with a sum equal to 100% of the value of the order within seven days counting from the day on which VISIT.PL sends the Client confirmation of receipt of the order form, as described in par. II pt. 2b.
- If VISIT.PL is unable to undertake the organisation of the events ordered by the Client, which may occur in particular due to a lack of vacancies, the total funds blocked by the authorisation process shall be released. VISIT.PL shall inform the Client of the fact that it is unable to organise the events ordered by the Client.
- Should the Client cancel all or some part of the event(s), funds to the value calculated on the basis of the provisions in par. IV shall be returned to the Client's credit card account.
- Should the credit card settlement centre refuse to authorise the credit card whose details are given by the Client, no contract is concluded and the Client shall be informed of the fact.
- Thee following provisions are applicable to bank drafts:
- If the value of the order is equal to or in excess of 1000 Polish zloty, the Client is obliged to effect payment of 35% of the value of the order within seven days counting from the day on which VISIT.PL sends the Client confirmation of receipt of the order form, as described in par. II pt. 2b. The remaining 65% of the sum is payable no later than 21 days prior to the event start date.
- If the value of the order does not exceed 1000 Polish zloty, the Client is obliged to effect payment of 100% of the value of the order within seven days counting from the day on which VISIT.PL sends the Client confirmation of receipt of the order form, as described in par. II pt. 2b
- The payment date is considered to be the date on which the funds are received into VISIT.PL's account and not the date on which the Client effected the draft.
- All fees and commission charged by the bank in connection with the bank draft constitute the Client's cost.
- Should the Client cancel all or some part of the event(s), funds to the value calculated on the basis of the provisions in par. IV shall be returned to the Client's credit card account. All fees and commission charged by the Client's bank constitute the Client's cost.
- The Client chooses whichever of the following forms of payment s/he prefers, as long as the given form of payment is available for the event ordered by the Client:
- WITHDRAWAL FROM THE CONTRACT
- The Client is entitled to withdraw from the contract and from participation in the event upon submission to VISIT.PL of a written declaration. In the case of orders submitted on line via the site www.visit.pl, submission of a written declaration is considered to be clicking on the appropriate link on the page displaying the order status. The date of the withdrawal is
taken to be:
- the date on which a suitable declaration is received
- the day after the day on which the Client fails to carry out actions defined in the contract (e.g. non-payment of sums due)
- the event start date if the Client does not take part in it. does not take part in it.
- Should the Client withdraw from a contract, the subject of which includes the reservation of accommodation in a hotel, castle or palace, the following cancellation conditions apply:
- The Client shall not be liable for any costs in the case of cancellation effected seven or more days prior to the event start date
- The Client shall be liable for costs equivalent to the first day's stay in the accommodation where cancellation is effected less than seven days prior to the event start date
- The Client shall be liable for costs equivalent to 100% of the value of the order should he/she fail to arrive at the accommodation without having informed VISIT.PL in advance.
- Should the Client withdraw from a contract, the subject of which includes an event other than those listed in pt. 2, the following cancellation conditions apply:
- The Client shall be liable for costs equivalent to 35% of the value of the order where cancellation is effected 21 or more days prior to the event start date
- The Client shall be liable for costs equivalent to 100% of the value of the order where cancellation is effected less than 21 days prior to the event start date or in the case of failure to take advantage of the events ordered without having informed VISIT.PL in advance.
- VSIT.PL reserves the right to alter the cancellation conditions described in these regulations for particular events. In such cases the cancellation conditions applicable for a given event shall be published at www.visit.pl and shall constitute an integral part of the presentation of the event, or the Client shall be informed of them in writing. Where cancellation conditions for a given event differ from the general conditions described in these regulations, the conditions for the particular event take precedence.
- In the case of the withdrawal of the Client or a participant listed by him on the Order Form for reasons not constituting the fault of VISIT.PL, owing to a passport not being granted or being suspended, or to non-possession of documents empowering border guards to grant permission to cross the border etc., the cancellation conditions described in pts. 2 and 3 shall apply
- VISIT.PL reserves the right to cancel events, alter the services provided or limit their number for reasons beyond its control and for reasons arising from the occurrence of force majeure circumstances, natural disasters, states of war etc.
- In the cases defined in pt. 6, VISIT.PL shall make every effort to provide Client with a replacement offer or to refund in full the monies paid.
- Amounts refunded are not subject to interest.
- The Client is entitled to withdraw from the contract and from participation in the event upon submission to VISIT.PL of a written declaration. In the case of orders submitted on line via the site www.visit.pl, submission of a written declaration is considered to be clicking on the appropriate link on the page displaying the order status. The date of the withdrawal is
taken to be:
- PARTICIPANT'S LIABILITY
- Participants in events are obliged throughout the duration of the event to possess valid documents entitling them to cross the borders of countries included in the programme and transit countries.
- The participant is obliged to observe customs regulations of the countries covered by the programme of the event, as well as the rules binding in places of accommodation.
- Participants are liable for damage caused by themselves and persons in their care, and shall pay for damage where it occurs.
- ORGANISER'S LIABILITY
- VISIT.PL is liable for the correct functioning of the event in accordance with the programme.
- VISIT.PL bears limited liability for the non-execution or unsatisfactory fulfilment of the contract if such limitation of liability has its roots in legal regulations binding in Poland or in international agreements.
- >VISIT.PL is not liable for imperfections in the event resulting from circumstances beyond its control, such as atmospheric conditions, state decisions, the effects of other circumstances arising as a result of force majeure, or through the Participant's fault.
- Inconveniences and difficulties of which Participant was aware prior to the event start date may not constitute the subject of claims.
- INSURANCE
- VISIT.PL, in accordance with the Polish Law on Tourist Services, has taken out third party insurance on behalf of Client to cover the costs of refunding payment made by Client in the event of failure to fulfil the contract for the provision of tourism-related services.
- VISIT.PL does not take out accident or health insurance, or insurance against loss of luggage on behalf of the Client.
- VISIT.PL recommends that insurance be taken out against accidents and medical treatment.
- COMPLAINTS
- Complaints concerning the services provided should first be filed by telephone to VISIT.PL within 24 hours of the situation arising that is the source of the complaint, otherwise they may be rejected without consideration. VISIT.PL allocates a unique Complaint Identification Number to each complaint and informs the person filing the complaint of this number.
- VISIT.PL shall make every effort to remove the causes of well-founded complaints, including by means of providing replacement services wherever possible.
- Complaints should be submitted in written form no later than 7 days from the end of the event. In order for complaints to be considered it is vital that they be reported by telephone during the course of the event, a Complaint Identification Number as referred to in pt. 1 be allocated, and that the Identification Number be quoted on the written report.
- All complaints should be submitted in English, German or Polish.
- VISIT.PL undertakes to consider complaints immediately and provide Participant with a written response within 30 days.
- VISIT.PL is obliged to refund the difference in value between the services described in the contract and replacement services referred to in pt. 2 in a situation where Participant does not receive replacement services of the same or a higher value. Client covers the costs of replacement services of a higher value if they are provided at his/her request.
- VISIT.PL shall not refund the costs of provision of services not used for reasons in whole or in part the fault of the client.
- PARTICIPANR'S PERSONAL DETAILS
- Participant consents to the storage of his/her personal data in VISIT.PL's database and to their processing for marketing and promotional purposes.
- VISIT.PL undertakes to provide protection for Participant's personal data in accordance with the recommendations in the Polish law on the protection of personal data, and declares that this data will not be made accessible to outside entities.
- Participant is entitled to inspect personal data that concern him/her, and is in particular entitled to complete, update, and simplify the data, and to temporarily or permanently withhold them from processing or remove them if they are incomplete, out of date, untrue, or were taken unlawfully.
- LEGAL BASIS
- Contracts on participation in events are governed by the law of the Republic of Poland.
- VISIT.PL signifies GRUPA START Sp. z o.o. with registered address at ul. Kapelanka 60, 30-347 Krakow, Poland.
